The Lahore court cited alleged evidence of promoting unregistered gambling apps.
Pakistan.- The Lahore district and sessions court has again rejected the bail plea of Pakistani YouTuber Saad-ur-Rehman, popularly known as Ducky Bhai, in a case involving the promotion of illegal gambling and forex applications.
The prosecution alleges that Rehman allegedly encouraged the public to invest in apps that were not registered with the Securities and Exchange Commission of Pakistan (SECP). The NCCIA has declared 46 apps illegal.
The defense, led by Advocate Chaudhry Usman Ali, argued that no witnesses were presented, no official notice was served, and the apps were not banned at the time of promotion. They also contested the application of Section 37 of the Prevention of Electronic Crimes Act (PECA) 2016, claiming the Pakistan Telecommunication Authority should have blocked the apps if they were deemed unlawful.
Despite these arguments, the court sided with the prosecution, citing strong evidence and the societal impact of Rehman’s actions on his young audience. It’s the second bail rejection for Ducky Bhai following a ruling by Judicial Magistrate Naeem Wattoo on September 23. The YouTuber, arrested on August 17 at Lahore’s Allama Iqbal International Airport, faces charges of electronic forgery, fraud, spamming, spoofing under PECA, and cheating under the Pakistan Penal Code. If convicted, he could face significant fines and imprisonment.
