The Philippines.- The Philippine Amusement and Gaming Corporation (PAGCOR) has adopted new rules on cash rebate and cashback programmes for electronic gaming setting caps and stricter approval requirements for operators. Under the updated framework, cash rebates based on player turnover or deposits are capped at a maximum of 1.5 per cent for slot games, electronic bingo, numeric games and sports betting. Table games and arcade-type games are excluded.
Cashback on player net losses is allowed at up to 15 per cent across all electronic games, subject to evaluation and approval by PAGCOR’s Electronic Gaming Licensing Department (EGLD), which will consider each game’s return-to-player rate.
All gaming system administrators, integrated resort licensees, operators and related service providers must submit marketing and promotional applications using EG Form No. 28 for approval prior to implementation. Programme structures must include tiered requirements covering minimum deposits, wagering thresholds, rebate rates and maximum payout limits.
The regulator classified cash rebates and cashback as marketing expenses, stating that they must not be treated as gaming losses or deducted from gross gaming revenue (GGR). It also prohibited combining multiple promotional incentives in a way that exceeds the prescribed limits.
A transition rule allows previously approved non-compliant programmes to continue only until the end of their approved period or until May 15, 2026, whichever comes first. No extensions, renewals, or modifications will be permitted beyond that date. The amendments have been incorporated into the regulatory frameworks for gaming system administrators and gaming venue operations, designated as Annex D-1 and Annex O.
